Which of the following most accurately describes the problem?

A HAULAGE boss. one of his drivers and a foreman have all been jailed following the death of pensioner who was run over by a truck when its brakes failed.

Joyce McVey was killed instantly when a car transporter belonging to Rotherham-based CarTrans, which was carrying seven Land Rover Discoveries, failed to stop at traffic lights in Southampton in September 2002.

Winchester Crown Court heard that Michael Roberts, who was driving the vehicle when it hit McVey, had complained to his empoloyer about the brakes on his vehicle two days before the fatal accident when they failed at the same spot (CM 7 October).

However, he changed his mind after being threatened with the sack by CarTrans owner Paul Duckmanton if he was wrong about the brakes' condition.

Duckmanton and his foreman, Terence Gleadall, later falsified inspection sheets and service records for the vehicle concerned. Police subsequently uncovered 40 inconsistencies in the paperwork.

Gleadall and Duckmanton were cleared of manslaughter but both of them pleaded guilty to two counts each of attempting to pervert the course of j ustice.

Duckmanton was jailed for eight months and Gleadall for four months. Mr Justice David Clarke sentenced Roberts to 12 months in prison after he pleaded guilty to manslaughter — Roberts was also disqualified from driving for two years.
