THE•Transport Tribunal in Edinburgh

on Tuesday upheld an. appeal by Arthur Nicol, haulage contractor, of East Side, Portlethan, Kincardineshire, against a decision of the Scottish Deputy Licensing Authority. The Authority refused the substitution of two contract vehicles to ordinary A licences.

In granting the full -licences sought, the Tribunal added a proviso in respect of the normal user declaration. Whereas, when the application was initiated, the vehicles were to be used for agricultural goods and requisites "within Scotland,the Tribunal's decision amends this to read agricultural goods and requisites "within central North East Scotland, including Edinburgh and Glasgow."

In presenting the decision, the president of the Tribunal, Sir Hubert Hull, said that the appeal did not raise any point of principle. " It has been fully argued over the prescribed battlefield." he commented.

"The mere fact that a customer supports an application for an A licence is, on the face of it, sufficient evidence that he wants the man to have an A licence. If he wants the man Co have an A Ilc.ence, he is asking that the contract A licence be cancelled: the simple reason for this being thara vehicle cannot have two licences at one time," he added.

the same day, Mr. •Eric B. Christofferson. haulier, of Havensburgh. Long Haven, Cruden Bay, Aberdeenshire, had his appeal refused. Mr. Christofferson appealed against a decision of the Scottish Deputy Licensing Authority not tO grant an application by him to have an A licence substituted for a contract A licence for one vehicle.

Without calling on the British Transport Commission, as respondents, to submit evidence, the Tribunal upheld the decision of . the Deputy Licensing Authority.
