The Transport Tribunal said it (did not accept that the non-receipt of the financial information was only a "supplementary issue". In its absence the TO was unable to find that the company was of good financial standing and revocation had to follow.

Neither did the Tribunal consider that Dixon's findings in relation to maintenance could be attacked.

It had been told that this was a husband-and-wife business and director and transport manager Angela Thomas also had to look after three children. The Tribunal accepted this, but pointed out that a transport manager must have continuous and effective responsibility for the management of the transport operations.
