Dixon reached his decion after the company, tradig as Thomas 011 iistribution, had appeared t its third maintenance elated public inquiry (CM 4} Oct and 8-14 Nov 2001).
Revoking the licence, the C said that the prohibition otices and an unsatisfac)r-y maintenance investigaOn convinced him that the ompany had failed to make roper arrangements to cep its vehicles and trailers t and serviceable, It appeared to have ?armed little from the two revious appearances at oblic inquiry and he did not ccept the claim that matters ad -improved immensely" ince the last public inquiry ist over a year ago.
Dixon added that the company had agreed to submit financial evidence by the end of September last year. That information had not been supplied so he could not be satisfied that the company was of the required financial standing.
The Transport Tribunal said it (did not accept that the non-receipt of the financial information was only a "supplementary issue". In its absence the TO was unable to find that the company was of good financial standing and revocation had to follow.
Neither did the Tribunal consider that Dixon's findings in relation to maintenance could be attacked.
It had been told that this was a husband-and-wife business and director and transport manager Angela Thomas also had to look after three children. The Tribunal accepted this, but pointed out that a transport manager must have continuous and effective responsibility for the management of the transport operations.
