Mr. Jackson-Lipkin submitted that Coward was not-taking-himself out of the category of an Arlicence 'holder "by restr:cting himself to .four customers.

Granting the' application, Mr. Muir said:" 1 am not satisfied about the restrie'tive effect on the A licence. In my view the A-licence holder is a man who can properly advertise himself as carrying goods anywhere. I do not like this view of restrictive declaration in respect of A liceuces."

The Authority also allowed eppiicafirms by Ouelch Carriers and Coward Bros. for variations of their A licences and by Tarbun's Transport for a. variation and a new A licence.

No Flynn Decision

DEcISION was reserved by Mr. J. . Qazdar, deputizing for the North Western Licensing Authority, at Manchester on Tuesday, on two applications by Flynn Bros. (Contractors) Ltd. (The Commercial Motor, May 17, 1963). The case, which was part-heard, involved the deletion of a 3-ton vehicle from B licence and the acquisition of a new 61-tonner, and the variation of the conditions attached to the B licence. The normal user sought was: " Roadmaking, buntline and demolition materials, scrap and solid fuel within a radius of 70 miles of base', with the exception of .George Wimpey and Co. Ltd. for whom the company wished to carry within a 100-mile radius.

Supporting the application, Mr. A. L. Dearden, of Stephenson and Clarke Ltd., solid fuel factors, said that his company had recently secured a large contract for pulverized fuel ash. British Railways objected, and evidence was also given by two independent road hauliers who stated that they had spare capacity.
