• When a vehicle examiner inspected three tipper• vehicles belonging to Waterloovile Plant Hire, of Waterlooville, Hampshire, last February, he issued two delayed prohibition notices as well as two defect notices.

But when Mr Robert Bason, owner of the business, appeared before the South Eastern LA at Southampton to show cause under Section 69, he maintained that one of the vehicles should not have been inspected because it had been off the road for two weeks and was being prepared for its annual retesting.
