RHONDDA-BASED William Gill & Partners escaped with a formal warning over breaches of the drivers' hours rules when several family members appeared before Welsh Traffic Commissioner David Dixon at a Cardiff disciplinary inquiry.

The partners in the skip hire business are three brothers, Michael. Dean and Royston Gill, who all drive for the firm. The transport manager is their cousin Paul.

Traffic examiner Philip Jones said an examination of 700 tachograph charts revealed 32 offences by drivers, mainly the brothers, of failing to take statu tory breaks and taking insufficient weekly rest by driving on a Sunday.

He believed the offences had been committed through ignorance, there being no deliberate attempt to exceed the permitted driving limits. They had driven on a Sunday for about an hour to collect skips.

The partners had since attended an operators' seminar and there was a new rota which complied with the regulations. Another 131 tachograph charts had checked for August-October with no offences being found.

He accepted that drivers had misunderstood that the 'automatic' tachograph was not fully automatic.

Paul Gill said they had been aware of the daily and weekly driving limits but had not known about Sunday driving. The statutory breaks had been taken although they had not been recorded.All their drivers had received fresh instructions.

Warning the firm about its future conduct, the TC said that although 32 offences out of 700 charts was under 5%, it was 32 too many offences over a short period of time.
