Which of the following most accurately describes the problem?

• At Watford magistrates court on Friday, W. W. Drinkwater (Willesden) Ltd., was fined £20 for causing a 20 ton g.v.w. lorry to exceed the permitted weight by 1 ton 12cwt. The vehicle was stopped on A412 at Maple Cross on December 11, 1968 and weighed by the MoT.

W. W. Drinkwater, who admitted the offence, explained to the court that the driver of the vehicle normally drove a 20 Cu, yd. ash lorry but on this occasion was driving a 10 cu. yd. sand or ballast lorry. Because he was not conversant with this type of vehicle he mistakenly loaded it with 11 Cu. yd. The drivers were instructed both orally and by written instruction not to exceed the legal maximum weight.

The magistrates took into account seven previous convictions.
