Which of the following most accurately describes the problem?

A Newton Stewartbased haulier has appeared at a Dumfries disciplinary inquiry to explain his failure to produce tachograph records on request.

James Rae, trading as Raeburn Contracts, who holds an international licence for two vehicles and two trailers, recently faced Scottish Deputy Traffic Commissioner Richard McFarlane.

Traffic examiner Alistair McCormack said that in August of last year he had visited Rae's premises and asked him to produce tacho records for July. Rae had said that he would produce them the following week but failed to do so. To date. these had still not been seen.

Rae said that he had been unable to provide the tachograph records on the day of the traffic examiner's visit as they were with the person who checked them on his behalf, a Mr Lambie. He had to go abroad but Lambie posted the tachograph records to the Vehicle Inspectorate. He felt he had complied with the VI.

McCormack maintained that the tachograph records had never been received.

The DTC said that he had had difficulty in understanding why Rae had not explained this until now. When there was a failure to produce a month's tachograph charts, he became concerned that either the records had not been made or the operator had something to hide.

Rae said that he had made no attempt to hide or conceal anything. The tacho charts had been lost, though other records were available.

Adjourning the hearing, tlDTC said that he was giving RE four weeks to provide thee other records. He also wante the Vito examine his system fc retaining charts.

"It is all about road safer and it is important that hour are recorded," he told Rai "Don't fight with us, please."
