'IN Monday. in Edinburgh, Scottish

Whinstone Quarries Ltd, and Limmer ind Trinidad Lake Asphalt Co. Ltd.. 7ere refused an arrangement which vould have allowed Scottish. Whinstone 'chides to handle I.immer prepared road naterials from Blackridge Quarry. 2ontinued from an earlier hearing (see rhe Commercial Motor, September 6 and slovember 8) the case revolved around he provision of road metal by Scottish Vhinslone to Limmcr. The materials vere then coated and distributed to road !ontracts.

Until May this year. Scottish Whinlone used its own and hired fleets to !diver the Limmer materials, produced n the same quarry, believing that it was egal to do so. On consideration, it was lecided to test the legality and the present tppl icat ion resulted.

Mr. T. Calder, of Scottish Whinstone, explained that eight vehicles on contract to the company had now been taken over by Limmer and Trinidad and that their .sole interest now was to assist by giving emergency deliveries as and when needed as they had she right type of insulated vehicles available in the same quarry.

Mr. R. Mackenzie. for the objectors, pointed out that if Whinstone had 50 vehicles, this would mean authorizing 50 new units for road and building material use and that the Licensing Authority could not license to meet the odd emergency.

The Scottish L.A., Mr. W. F. Quin, said that the application must fail, as the evidence showed that there had been transport available on all except the very rare occasions. There was no case for the objectors to answer, he added.
