APPEAL AGAINST COURT DECISION ON BUS TYRES

AN appeal has been lodged against the acquittal of Dundee Corporation and one of their bus drivers in a case involving allegedly defective tyres. The corporation were last week cleared by Dundee Sheriff Court of causing and permitting Peter Forbes Smart to use a bus with defective tyres. Smart was found not guilty of driving recklessly or carelessly.

Smart was driving a bus which collided with guard rails outside a hospital and knocked down an aged pedestrian. He attributed the accident to a rear-wheel skid.

Mr. A. A. Cradock, Ministry of Transport vehicle inspector, told the court that three of the tyres were badly worn, and he did not think they should have been on a public service vehicle. He was not prepared tn say they were dangerous, but if he had seen them in that condition he would have ordered them to be changed immediately.

Mr. W. L. Russell, Dundee Corporation transport manager, said he was not satisfied with the canvas showing on one of the tyres. which ought to have been changed. However, none of the tyres was dangerous. Mr. D. J. Messer, a tyre company service engineer, claimed that the tyre most worn was good for another 4,000-5,000 miles. Another service engineer, Mr. E. Hide, 'said a tire with no tread was better under some conditions than one with tread.

Sheriff Christie said the evidence raised, a doubt and he accordingly found the corporation not guilty.
