Which of the following most accurately describes the problem?

A CHESTERFIELD haulier has been given interim authority despite hauling third-party trailers for nine months without licence authority and a conviction for running a dangerous truck.

Nunes Transport appeared before North Western Deputy Traffic Commissioner Patrick Mulvenna at a Golborne disciplinary inquiry.

Vehicle examiner Bernard Unwin said that in October 2004 a Nunes tractor unit was given a delayed prohibition for a loose wheelnut, The semi-trailer was given an S-marked immediate prohibition for a missing ISO cable, which rendered the ABS system and load sensing valve inoperative. This in turn could have had a serious impact on the vehicle's handling.

Nunes' director, William Pickering, said it was operating two vehicles hauling trailers for Hopkinson Transport. The prohibitions were issued before the firm acquired a licence. It had been convicted of operating without a licence and using a dangerous vehicle.

He admitted the firm was not licensed for any trailers and said it was seeking an increase in authority to four vehicles and four trailers. In reply to the Deputy IC, Pickering said he had not known the firm needed a licence for trailers as the trailers it was now pulling were already licensed to Hopkinson Transport.

The Deputy TC said the vehicles were being operated unlawfully and though there was an application to increase the licence authorisation to four vehicles there was no application for trailers.

He granted the company interim authority for four vehicles and four trailers with a condition that not more than two vehicles and two trailers could be operated pending a satisfactory maintenance investigation by Vosa.
