Which of the following most accurately describes the problem?

THE following, an extract from the Memorandum of Agreement of the Eastern Area Joint Council for the Road Haulage (Hire and Reward) Industry, shows just how comprehensive these agreements can be: Flexibility of working (a) It is recognised that road haulage is a service industry and the hours of work must be reasonably flexible. This will call for the acceptance of reasonable overtime working as required.

(b) Whilst it will normally be the case that drivers shall be engaged regularly upon driving vehicles of the category described in the heavy goods vehicle licence held, and receive the appropriate rates of pay, circumstances may occur where for the good running and efficiency of the business, drivers may be called upon to drive vehicles of a different type and class (subject to holding the necessary qualification) and in such cases the following shall apply: (i) Driving a lower class vehicle — The higher rate will be paid for all time such duty is Performed.

(ii) Driving a higher class vehicle — The higher rate of pay will be paid for each day such duty is performed and if the vehicle is driven for three or more days in a week, payment for the whole week will be at the higher rate. Telephoning for instructions while off duty (a) If a worker during the period between two spells of duty is required to telephone for instructions, he shall be paid £1,00. This provision shall not apply when the worker is required to call within one hour following a spell of duty.

(b) On each subsequent occasion during the same period between two spells of duty on which the worker is required to telephone for instructions, he shall be paid £3.00. Provided that if when telephoning on such occasions the worker is instructed to commence work within one hour of so telephoning, he shall be paid £1.00 instead of £3.00.

(c) All payments made under this clause are inclusive of the cost of a local telephone call.

Productivity and bonus schemes It is agreed that productivity and bonus schemes where desirable shall be negotiated, established and implemented at company or Jepot level. Non-prejudice clause It is agreed where, at the signing of this Agreement, higher rates of remuneration or superior conditions of employment existed, then they shall remain and nothing contained in this Agreement shall supersede or prejudice these better rates and conditions of employment.

Casual Labour Employees covered by this Agreement shall be regarded as permanent employees and the employment of casual labour shall not take place except by mutual agreement between Employers and employees. Should such casual labour be employed the rates of pay and conditions of service of such persons shall at all times be no less favourable than the minima set out herein.
