SCOTTISH TRAFFIC Commissioner Joan Aitken has granted an 0-licence to Troon -based Gerard McCue, but for two vehicles rather than the three applied for.

In his application McCue, who trades as Task Structures, disclosed that he had given a voluntary undertaking to the Insolvency Service not to hold a directorship or take part in company management for six years after Task Scaffolding was placed in voluntary liquidation in November 2001 with debts of £230,000.

McCue had been a director of Task Structures; the Insolvency Service reported that he had misappropriated and failed to account for assets transferred to Contractor Task, a company of which his wife Julieann was the sole director.

McCue had also been a director ofTask Scaffolding, with Juliearm as company secretary. She had resigned as director of Contractor Task in October 2006. That company, which held a three vehicle 0-licence, had no current directors.Julieann McCue had been company secretary of a failed company and this should have been disclosed when Contractor Task applied for a licence.

The TC said the date of that application was very close to the failure of Task Scaffolding and it would appear that Contractor Task was a phoenix company.

McCue told the TC of problems with the bookkeeping and financial management of Task Scaffolding. He believed his naivety on the paperwork side was part of the problem. He had agreed with his wife that if she paid for his defence in a court case he would relinquish ownership of the company's goods — he was employed by Contractor Task in the later stages of 2003 and in 2004 as depot manager.

The TC said it was in McCue's favour that he had disclosed the Insolvency Service matters. There were sufficient financial resources for two vehicles but not for three.
