ized street in Torquay, the owners, Embankment Motor Co., Ltd., Plymouth, were prosecuted last week. They were accused of having negligently failed to comply with certain conditions of their road service licence regarding routes taken-by coaches through Torquay on authorized tours.

For the prosecution it was stated that a coach proceeded down Union' Street towards the Strand on March 30. It was taking passengers on an excursion from Plymouth to Torquay and Teignffiouth, but the street used was not on any coach route.

Mr. T. Congton, traffic manager, told Torquay magistrates that new men followed another coach or were carried as passengers with experienced drivers. Memos of conditions were signed by each driver, but the police had not asked for one relating to the Torquay route.

The driver, Mr. G. J. Medland, who had been employed by Embankment Motors for more than three years, said he had previously worked for a Modbury concern who used the route.

For the company, Mr. G. IVIcMurtrie said police evidence was conflicting. If the defence evidence were accepted, the company could not have been negligent.

The magistrates found the case proved but, in view of the mitigating circumstances, said an absolute discharge would be given on payment of £5 costs.
