Which of the following most accurately describes the problem?

• In refusing a bid for a new national licence for 14 vehicles and four trailers by James Gaffney & Sons, Scottish Licensing Authority Keith Waterworth has described the company's application as fraudulent.

In October Waterworth reserved decision after a public inquiry, pending the production of further information by the East Kilbride-based company. (CM 12-18 October).

In his decision, Waterworth said that since October fresh information had come to light about the status of the nominated transport manager, Mary Starrs.

Investigations had revealed that she did not seem to be employed by the company and that a signature submitted in evidence in October was not in fact her signature.

Therefore, the company appeared to have made a fraudulent application.

Waterworth said he had also taken account of: nine immediate prohibition notices for neglect imposed since May 1988 when the company began operating under interim licence; the number of convictions recorded against the company; the company's failure to notify those convictions; and its failure to fulfil statements of intent concerning overloading and vehicle maintenance.

He took the view that this suggested that James Gaffney & Son had insufficient regard for the licencing system.
