In view of this and the customer evidence given, the LA had deleted all nine artics from the /6A licence.

Applications to acquire two 4-ton vehicles in place of ones of 4 tons 11 cwt and 44 tons (licences /7A and /8A respectively) were granted previously. On the /9A licence 13 vehicles with weights totalling 53 tons will be exchanged for a similar number weighing 53-i tons.

Solicitor for the haulier had submitted that because the applications, most of'which were eligible for automatic grants, had been lodged before the LA's notice under Section 177 there was no basis for the Section 177 inquiry.
