• by Michael Jewel A Lancashire operator has been kicked out of the industry following a series of maintenance offences, and two other firms using the same transport manager are to be investigated.

North Western Deputy Traffic Commissioner Mark Hinchliffe revoked the Operator's Licence held by Keith McGuinness, trading as KMC Transport, of Bolton.

This followed an adjournment because the DTC required the attendance of McGuinness's nominated transport manager, Colin White of North East -achograph Services.

The DTC heard that between March and November last year two immediate and two delayed prohibitions, and three variation notices had been issued, one showing a severe maintenance failure. The inspection records were unsatisfactory in a number of ways (CM19-25 Sept).

The DTC said the case illustrated the difficulties that could arise when an operator relied upon an agency.

Among documents produced was a letter from White to McGuinness in May 2000 referring to a substantial number of drivers hours infringements, but there was no evidence of anything being done about those infringements. In the meantime, said the DTC, White continued to accept his retainer from McGuinness.

The DTC rejected claims that White met McGuinness four times a year and spoke to him on the telephone monthly. it was now conceded that the only time they met was when the licence application was submitted.

He added that White was the transport manager for two other operators and there had been no difficulty with them as they had co-operated with him fully. However, White had fallen far short of the standards required of a transport manager in relation to McGuinness' licence.

Ordering an investigatior into the operations of the other two operators, DRA Caravans and PJ Lee, the OTC said that if the position was unsatisfactory they would be called to Public Inquiry.
