Which of the following most accurately describes the problem?

A K ENT haulier has had the revocation of its licence delayed on appeal to give it time to make a fresh application. However, the company was censured for failing to meet the requirements of the licensing regime.

While dismissing the appeal against the revocation of the licence held by TTS Trucking, the Transport Tribunal directed that its decision not take effect until 12 December to give the company time to make a fresh licence application.

TTS Trucking held a licence for five vehicles with operating centres at Gillingham and Aylesham. In August 2004, it sought to transfer the Gillingham operating centre to Strood. The application form and a copy of the appropriate newspaper advertisement were sent to the Traffic Area Office (TAO) but never received.

In October 2004, a vehicle examiner visited the Gillingham site and found it not in use. The TAO wrote twice to the company asking for an explanation before receiving a reply referring it to the application for the Strood site. The TAO wrote back saying the application had never been received, and requested that the company make a further variation application with the appropriate fee within 10 days. The company failed to respond, a further letter was sent and again the company did not reply.

In March, the TAO wrote to TTS, saying the Traffic Commissioner was considering taking action against its licence and offering a public inquiry. The company replied saying the Aylesham operating centre was perfectly adequate to meet its licence obligations.

The Strood site consisted only of secure off-street parking facilities convenient for drivers to change over and had now been superseded by a more convenient one in George Summers Close, for which no application has yet been received.
