PES TRADING UK, which was refused an O-licence after staff working for the Traffic Commissioner (TC) suspected it had tampered with bank statements, has won its appeal to have its application looked at again.

Ramesh Daryanani, boss of the firm based in Enfield, London, was contesting the October 2010 decision of John Baker, South Eastern and Metropolitan Deputy Traffic Commissioner (DTC), to refuse his business authorisation for a restricted licence for two vehicles. Case workers for the DTC believed the font of the word “limited” on statements did not match the rest of the text. On appeal, Daryanani said no tampering had taken place and all statements had been amended, stamped and endorsed by the bank. Appeal judge Frances Burton said: “The firm should have been called to public inquiry to explain the circumstances of the bank’s amendment of the statements.”
