A Worcestershire agricultural contractor with a 100% Initial failure rate at annual test since 1999 has escaped with a formal warning at a West Midlands disciplinary inquiry.

Upton-upon-Severn-based David Owen holds a restricted licence for one vehicle and appeared In front of the West Midlands Deputy Traffic Commissioner Alan Bourlet.

Vehicle examiner Glyn Smith said that two immediate prohibitions, one of which was endorsed IS', had been issued to Owens vehicle. The stated interval between Inspections was six weeks but an examination of the Inspection records showed periods of between three and seven weeks.

The vehicle in use was not specified on the Operator's Licence, had no 0-licence disc and its inspection records were badly filled in.

In fact, the specified vehicle was parked up in a muddy field and Owen told him that he had attempted to sell it at auction, The vehicle did a fair amount of off-road work and he considered the inspection interval ought to be reduced or have a mileage alternative, as the work was very seasonal.

Owen said that the vehicle given a prohibition In June 2000 had not been inspected as he had relied upon the valid MoT certificate following its purchase, it had only been used for about two weeks and was off the road when the prohibition was issued. The second prohibition was issued when the vehicle was sent In for test the following year before being back out on the read following the foot-andmouth epidemic.

The Volvo truck had failed its test because the previous owner had put holes through the spray suppression eeulpment for ropes and the headlight was also out of alignment.

He gave the DTC undertakings to have the vehicle inspected every six weeks, or 6,000 miles, whichever was the sooner; and to have It roller brake tested every six months.
