West Midland Deputy Traffic Commissioner Alan Bourkt has adjourned a licence bid from the Dudley-based Jewkes family until he hears evidence from two other operators to help explain the confusion.

David and Ciarisa Jewkes, directors for Trinity North UK, were seeking a new international licence for three vehicles and four trailers.

For the company, Michael Carless said that Jewkes Transport had been initially put into voluntary liquidation following a disputed claim by Customs and Excise. This became a compulsory liquidation on 13 January.

Traffic examiner David Hughes said that on 22 January a vehicle driven by David Edmunds was stopped In a check. Edmunds claimed he was employed by Jewkes Transport and was using the vehicle on its behalf. In April a second vehicle was checked at the Dartford Tunnel. No 0licence disc was displayed, the vehicle was wrongly taxed and the semi-trailer was issued with a prohibition notice.

Transport manager for Trinity North, Shane Jowkes, later admitted using the vehicle and employing the driver. He said he believed it was covered by a licence held by Michael Buckley, who was employed as a part-time transport manager. Shane Jewkes said that they had operated the vehicle on Buckley's 0-licence for several months as he genuinely believed that it was in order. David Jewkes said the vehicle had been taxed at the private HGV rate because of his short-sightedness.

Hughes said DVLA records showed three vehicles were taxed at the private HGV rate. Asked why, David Jewkes said he must have ticked the wrong box when taxing them. He confirmed that he had mistakenly taxed vehicles on three separate occasions. Shane Jewkes conceded that one of the other vehicles had been used to move empty trailers In connection with work they were subcontracting out.

He said Edmunds had been working as a subcontractor and he had records to prove he had never been an employee.

Carless said that Trinity North worked for blue chip companies and blue chip companies did not employ rogues, If the Jewkes had entered Into agency agreements with the other operators they could have done what they did quite legally, Adjourning the proceedings and refusing the company interim authority to operate, the KC said he had a number of grave reservations and he required all three operators to appear before him at the same time.
