TWO FIRMS RUN by the same family have escaped penalty after the TC accepted they were taking steps to resolve maintenance problems which had surfaced since the death of the founder last summer.

North Western Traffic Commissioner Beverley Bell decided to take no action against the licences held by Debra Howard, trading as JD Haulage, and J&J Bulk Haulage, of which Howard was the sole director. The two firms had been called before the TC at a St Helens disciplinary inquiry because of concerns over maintenance and hours.

Debra Howard said the limited company had been owned by her late father Barry, who died in August her mother was now the sole sh a re holder.The two businesses. which were operating four vehicles and one trailer,hauled aggregates and ready mixed concrete they were the preferred carriers for T afarge Ready Mix. The businesses operated as one and it was planned to amalgamate them under the umbrella of the limited company.

Appearing for the two firms, Michael Cunningham said Barry Howard had been a haulier of the old school who carried a lot of information in his head. His death had left the family in a quandary but they had faced up to their responsibilities. Running two businesses created more work than was necessary.

The TC said that despite difficult times the family had taken on board the vehicle examiner's criticisms in August 2003 and that said something about their commitment. Despite the difficulties they faced, they had put things right and were continuing to do so.
