Which of the following most accurately describes the problem?

Maintenance problems have resulted in the twovehicle licence held by a Brecon plant hire contractor being suspended for a week.

Malcolm Davies, trading as MH Davies Contractors, had been called before the Welsh Traffic Commissioner David Dixon at a Heath disciplinary inquiry following an unsatisfactory maintenance investigation, and allegations that one of his vehicles had been involved in a road traffic accident.

Vehicle examiner Emyr Williams said that two previous maintenance investigations had proved unsatisfactory and prohibitions had been issued. During the current investigation, one of the problems was the lack of maintenance records; there was no forward planning system or driver defect reporting system In place. The odometer on one vehicle was not working.

There were problems over brakes, but he con ceded that roller brake testing facilities in the area were sparse.

Maintenance was contracted out, and advice given in the past had not been acted upon.

Davies said that the driver of the vehicle allegedly involved in the accident was adamant that it was not his vehicle. It appeared that a "parcel" had fallen off a vehicle and hit a passing car. However, his vehicle had been carrying sail, The vehicle had been impounded by the police and taken to Pontypool. The matter was still unresolved.

Accepting that inspection records were missing, Davies said that he had invoices showing that the work had been done.

Suspending the licence, the TC said that he could not take account of the alleged accident. He warned that should Davies appear at a further Public Inquiry, it was likely his licence would be revoked.
