A West Yorkshire tyre firm has lost its licence after blaming the company's former owner for its mainte nance convictions. Pontefract-based JR Tyres Collection & Disposal, which held a licence for five vehicles and three trailers, appeared before North Eastern Traffic Commissioner Tom Macartney at a Leeds disciplinary inquiry. Vehicle examiner John Fielden said an examination of the firm's vehicles in September showed they were generally in a peer condition and three defect notices were issued. In addition only two maintenance records were available; he was told the ethers were missing due to a break-in at the company's former premises.

The firm's vehicles had previously attracted seven immediate and five delayed prohibitions.

Director David Singer said he had acquired the company in January and felt he was being penalised for someone else's wrongdoing. Since the takeover he had been studying to gain a CPC and was seeking to rectify the inconsistencies in the maintenance and drivers' records. Immediate prohibitions issued to a vehicle and trailer in May last year were imposed when they were on their way to be scrapped, he added.

Macartney referred to a series of 12 convictions over the past 15 months for failing to ensure the return of tachograph charts within 71 days, and for using vehicles without test certificates and with an uncalibrated tachograph. He described this as "worrying". However, Singer said that these convictions were committed before he acquired the company.

He said the old boss was money oriented and it had been a question of "get the wagons out". "I am making every endeavour to rectify the problems I have inherited," said Singer.

Revoking the licence and disqualifying the company from holding an 0-licence until the end of December 2003, Macartney said that Singer had no doubt bought the company at a price which reflected the inherited problems. The company's record was abysmally poor.
