Which of the following most accurately describes the problem?

• A bid for a new four-vehicle licence by Glamorganbased Simon James was withdrawn at a Cardiff public inquiry when it became clear that James was in partnership with his brother Matthew.

James, trading as MCN, had applied for a new licence authorising four vehicles and two trailers based at Gilbert Gardens, Gilbert Lane, Cadoxton, Barry.

The application was opposed by Vale of Glamorgan District Council and neighbouring residents.

After hearing financial evidence in private, South Wales Licensing Authority John Mervyn Pugh said it was evident from the tenancy agreements and accounts put before him that there was a partnership.

Withdrawing the application, Paul Carless, for James, indicated that a fresh application would be made in the name of the partnership.

Mervyn Pugh said that there were environmental matters that would require detailed investigation. He would also need to be satisfied that the partners were entitled to use the building on the land.
