HE SON OF A haulier whose -licence was revoked has had is own licence revoked because e had forgotten undertakings given just over a year ago.

Smethwick, Sandwell-based Paul Harper, trading as Harper's Waste, had his four-vehicle Icence revoked from the end of July by West Midland Traffic Commissioner Nick Jones Harper had been granted a fcence following the revocation of the licence held by his father in April 2008, and after he had given a series of undertakings in regard to vehicle maintenance, the analysis of tachograph records, and the employment of a transport consultant Vehicle examiner Tim Cropper said he carried out a maintenance investigation following the issue of an `S'-marked prohibition. indicating a serious lapse in maintenance, after some difficulty contacting Harper.

Defect books were seen in all vehicles, but no defects had been recorded. Harper did not keep a forward planning system and relied on his garage to notify him when inspections were due. The MoT failure rate was 100%. An advisory notice was issued for one of the three vehicles inspected. Harper said he recalled there being an undertaking to have a maintenance audit, but could not remember what the other undertakings were. He had discussed the 100% MoT failure with his garage three months ago, but still used the same garage.

Tachograph records were checked by the Road Haulage Association (RHA) although no monthly reports were prepared.

Harper agreed he had failed to implement recommendations made following an RHA audit.

The TC said he considered that if Harper did anything it would be the very minimum he felt he could get away with. His lack of adherence to the undertakings and the RHA's recommendations rendered him unfit to hold an 0-licence.
