IIIThe regulations imposed by the Transport Act are a fact of life and the same standards must be applied to the holder of a one-vehicle restricted licence as those applied to a large haulier, West Midland LA Ronald Jackson, told farmer Peter H. Parker, of Pershore, Worcestershire, during disciplinary proceedings in Birmingham. The LA said Parker had originally been asked tO attend a public inquiry at the beginning of May, but since Parker said he had a long-standing commitment elsewhere, it was adjourned until June, when Parker again said that he was unable to attend. The case was dealt with in his absence and after evidence from a traffic examiner, Parker's licence was suspended until he appeared at a public inquiry.

Parker had been convicted of three tachograph offences, said the LA. However, nominal fines were imposed on each occasion as the magistrates were told that Parker had ceased trading.

In evidence, Parker said that he had probably ceased operating the lorry at that moment in time but he had not ceased trading. He was a farmer. The offences had arisen when his driver used the wrong tachograph charts — a total mistake.

The LA said that he appreciated that Parker was a farmer but his responsibilities as the holder of an operator's licence were the same as the National Freight Consortium operating thousands of vehicles. If Parker's driver made a nonsense of it, Parker was the fellow that suffered.

Lifting the suspension, and taking no disciplinary action, the LA warned Parker not to do it again.
