Which of the following most accurately describes the problem?

A PUBLIC INQUIRY has been adjourned so that a haulier's legal team can examine handwritten notes made by VOSA when it interviewed the company's transport manager.

T&P Logistics had been called before the West Midlands Traffic Commissioner Nick Jones.

The company had previously appeared before the TC in 2007 when its licence was curtailed because of drivers' hours and tachograph offences and the then transport manager. director Terence Ward, was held to have lost his repute as a transport manager.

Vehicle examiner Mark Jewess said it appeared that the current transport manager, Graham Thomas, had little or no authority in making decisions over maintenance.

David Glover, for the company, said that was not accepted.

Jewess agreed that Thomas had jurisdiction over the day-today running. He also agreed that a three-hour interview had been condensed to eight bullet points in his report.

After lunch, Jewess produced his original handwritten notes from the interview.

The TC said the key issue was whether Terence Ward had passed over the transport manager function or whether he retained some of it.

If the latter turned out to be the case, added the TC, the impact could be very significant and could even lead to the revocation of the licence.

After traffic examiner Tracy Love said she was also able to produce her notes that were taken at the time, Glover asked for an adjournment, saying that the interview notes had only just been made available.
