NEWPORT BOROUGH Council has failed to block a licence application by Craig and Dean Simons, trading as Simons Bros Transport. Its objection on safety grounds was rejected by Welsh Traffic Commissioner David Dixon because there had been no history of accidents in six years of operations.The hearing had previously been adjourned when the council failed to appear at a Cardiff inquiry ( CM 4 August).

The council had objected to the bid for a licence authorising two vehicles and two trailers based at Drnidstone Road, St Mellons, citing problems with access to the operating centre.

Apologising for the previous failure to attend,John Gibbons, an assistant engineer with the council, said according to guidelines laid down by Gwent County Council, there were problems with the lack of depth from the highway to the kerb. He admitted there was no history of accidents.

The brothers' father and transport manager, Donald Simons, said they had been driving in and out of the premises for six years without any problems and the access was used by the main contractors when the M4 was built. They would rather move than take some trees down. There was no way that vehicles could achieve the 60mph speed limit on the adjacent road as it was single track for 300 yards.

Granting the licence.theTC said the council needed to be careful to look at the national guidelines for the haulage industry rather than local ones.
