II William Roberts, who trades as Roberts Coaches, of Aylsharn, Kent, has had his public service vehicle operator's licence, authorising seven vehicles, revoked by the South Eastern Traffic Commissioner Brigadier Michael Turner, following a conviction for handling a stolen tyre.

In April Roberts was convicted at Maidstone Crown Court of handling stolen goods, being fined £250 and ordered to pay £250 compensation and £406 prosecution costs.

Roberts said that he had pleaded not guilty and he was not guilty. He knew nothing about the tyre that had been found on his coach. He did not fit the tyres and he was unaware that a stolen tyre had been fitted. He had wanted to appeal against the conviction, but there were insufficient grounds.

Brigadier Turner said he could not judge the circumstances. He was not in possession of all the facts put before the Crown Court. He could only take account of the conviction, which was a fact. He could not judge whether an appeal would have been successful. The fact was that there was no appeal The stolen goods concerned were a tyre, or tyres, belonging to the East Kent Road Car Co, another operator. The question was whether that conviction was sufficient to destroy Roberts's repute as an operator, and the Traffic Commissioner said that it was. In those circumstances, he had no alternative. He must revoke the licence.

Brigadier Turner directed that his decision would not take effect until the time for any appeal elapsed, or any such appeal be determined. He advised Roberts to seek legal advice.
