BUSINESS CHANGED: APPEAL • UPHELD

/-3. A CHANGE in the functions of an acquired haulage business was alleged on Tuesday when S. Harfoot and Sons, Ltd., Barry, Glam, appealed successfully to the Transport Tribunal against a grant by the South Wales Licensing Authority of an application by Mr. A. J. Parfitt, of Seven Sisters, Glam, to substitute a vehicle of greater carrying capacity on his B licence.

Mr. C. J. Hfardwicke, for the appellants, submitted that when Mr. Parfitt took over the 21-ton container vehicle and the business of Mr. G. B. Rees, of Llangenith, in 1956, the licence covered all goods within 30 miles of Llangenith and meat for the United Carriers, Ltd.. within 60 miles.

Almost immediately, said counsel, he changed the 'nature of the business. He applied to substitute a tipping vehicle, because he had obtained a contract to carry coal for the National Coal Board and asked for the condition concerning the transport of meat to be deleted.

Mr. Hardwicke maintained that there was a clear intention by Mr. Parfitt not to carry on the original work of Mr. Rees.

Mr. Rosser John, for Mr. Parfitt, submitted that the Licensing Authority appeared to have been satisfied that there had been no complete change in Mr.

Parfitt's business. He was still doing general work.

Allowing the appeal, Mr. Hubert Hull, president, said the mere fact that Mr. Parfitt had been lucky enough to obtain the Coal Board contract did not entitle him, as a right, to a licence to perform it. There was no evidence that he could not carry out the Coal Board work with the smaller vehicle. In the Tribunal's view he had greatly changed the sphere of his operations.
