AN appeal by Kings and Co. Ltd. against refusal by the Scottish Licensing Authority of an application for two low-loaders with the condition of "civil engineering plant in Great Britain" was allowed (with a condition) in Edinburgh on Tuesday. Mr. J. B. T. Loudon contended that this was Gavin Wilkie Ltd. versus Watson Plant Co. in reverse, in which case the Tribunal had ruled concerning low-loaders that special vehicles should be used to the maximum extent. Mr. R. Mackenzie objected to the comparison. If accepted, he said. it would encourage every C operator of a low-loader with a little spare time to demand a B licence. Plant hirers had no special status justifying this free grant of low-loaders, he added.

Tribunal, referred to the evidence of convenience offered by the witnesses if the application were allowed, evidence supported by letters including two in identical terms drawing the inference that they were drafted by the appellant, which was as good an indication as any of what the appellant wanted. The terms in those letters were more restricted than a licence in the terms sought, said Mr. Squibb. if a licence were granted to enable the appellant to do work of the nature described it seemed to the Tribunal that the objectors were left with no good ground on which to pursue objections.

The Tribunal therefore allowed the appeal but imposed the condition: " civil engineering plant as return loads from sites where licensees are working as contractors ".
