Which of the following most accurately describes the problem?

• "Lenient" action was taken by the Scottish deputy Licensing Authority, Mr. L. A. Wells, in Aberdeen last week, when he called before him under Section 178 Burgess Transport (Keith) Ltd. and its subsidiary company, George R. Burgess (Contractors) Ltd.

Following a fleet inspection, MoT examiners found there was no proper programme for preventive vehicle maintenance. At the end of last year 13 vehicles operated under A and B licences by Burgess Transport were inspected and one immediate and five delayed prohibitions were issued. The three C-licensed vehicles belonging to the subsidiary company, received one immediate and one delayed prohibition.

Mr. G. R. Burgess, managing director of the companies, said that efforts had been made to secure a better system of maintenance. After recent staff trouble, the companies had lost a mechanic, but assured Mr. Wells that all problems had been solved. He promised that his companies' vehicles would not operate again while in a dangerous condition.

Giving his decision to suspend one vehicle for a month, Mr. Wells said that he considered this a very serious case; had it not been for the special conditions he added, a much harsher penalty would have been imposed.
