THE London and North Eastern Rail. way Co. bas been successful in the Yorkshire horsebox appeal case, to which reference was made last week. The Appeal Tribunal, last week, allowed the railway company's appeal against the decision of the Yorkshire Licensing Authority to grant Mr. P. Kelly. of Malton, an A licence for a horsebox.

The L.N.E.R. provides horsebox services in the district, and, in announcing the Tribunal's decision, the chairman, Mr. Rowand Harker, K.C., said the Tribunal had come to the conclusion that these services were adequate. He also remarked that, during the case, it was pointed out that, at the end of March, 1934, the railway company increased its charges, owing to higher taxation.

It was suggested that the fact that, shortly afterwards, Mr. W. Easterby, a Melton trainer, invited Mr. Kelly to

start business at Mallon, was more than a coincilence, and that the real reason why Mr. Kelly was persuaded to go to Mahon was the increased railway charges. The Tribunal's dodbts on that point were completely removed by a letter which Mr. H. D. Bazley (another Malton trainer) had addressed, in February of this year, to a number of trainers in the Melton district, with reference to the hearing of Mr. Kelly's appeal.

This letter suggested that, if the L.N.E.R. obtained a monopoly it could raise its charges. The chairman commented on the fact that, if the railway company was so ill-advised as to increase its present charges without complete justification, no doubt the Licensing Authority would take that matter into consideration when -the company applied for a renewal of its licence. The Tribunal made no Order as to costs.
