Which of the following most accurately describes the problem?

• A Licensing Authority is required to refuse a licence application unless it has been properly advertised in a newspaper circulating in the applicant's home area.

This was made plain by West Midland LA John Mervyn Pugh when he adjourned the application hearing for a week of AS Audhali Farm Gate Fresh Poultry, of Hatton, Warwickshire, to add three trailers to its 12-vehicle licence.

Neighbouring residents, who are opposed to the application on environmental grounds, claimed that it had not been advertised in a newspaper but in a free magazine which did not circulate in the area.

For the company; Martin Jones maintained that the publication was available at the local shop in Hatton Village.

Adjourning the proceedings, Mervyn Pugh said that enquiries would have to be made with the publisher before he could make a ruling on the matter. Earlier, Jones told the LA that the trailers were required to enable the company to reduce the number of artics hired from haulage contractors visiting the premises. He conceded that vehicles left the site between 03:30 and 05:30hrs to collect live poultry and later in the day delivered dressed poultry to retail and wholesale outlets, The residents complained about problems with exhaust emissions and the disposal of old engine oil and parts. They expressed concern about the safety of children because of the amount of traffic using the access lane to the site.
