Which of the following most accurately describes the problem?

A SUBSIDISED minicoach service to the Sunday Market, at Ingliston, near Edinburgh, will soon be under way. This follows a majority decision in favour of J. Curran Transport Ltd, of Edinburgh. They overruled a contention by J. B. T. Loudon that there was: No case to answer; a completely satisfactory service and danger of loss to Scottish Omnibuses Ltd and Lothian Region who objected.

On the claim that there was no case to answer, Mr A. B. Birnie said they would have preferred Spook Erection — the subsidising party — to be present, but they had decided there was no case to answer and would, therefore, ask the objectors to proceed.

Curran contended that it was not for the applicants to accept the onus of proving their case: it was for the objectors to show they were not needed on a route.

Mr Birnie said the majority -decision, which must be final, was that, having agreed there was a case to answer, they believed the applicant would generate traffic. After hearing the evidence, they had decided to grant the application.
