A DERBYSHIRE haulier has won a partial victory after the Transport Tribunal quashed his disqualification from holding an 0-licence for a period of three years.

However, the Tribunal upheld the revocation order made against Ripley-based Richard Dobb, trading as EC Logistics, by North Western Deputy Traffic Commissioner (DTC) Tom Macartney. Dobb held a licence for three trucks and three trailers. Dobb said that he had decided to close Dobb Bros Ltd after his father retired and because of the financial problems in general haulage. He sold Dobb Bros through an advert in CM for (CM 3 July 2008).

The DTC said that it was incredible that an 0-licence could be sold for £1 in response to an advertisement. It would have been simply easier to allow the limited company to lapse by writing to Companies House, which cost only a second-class stamp.

The sale of an 0-licence as a live entity, allowing others to function on that licence without the knowledge of the TC, went to the very heart of repute. It was a de vice that might have allowed vehicles to be used unsafely and illegally in all sorts of ways (CM 31 July 2008).

Before the Tribunal, Dobb said he had been very depressed and had wanted to get rid of the company as quickly as possible. He had told the Traffic Area Office (TAO) that he had resigned as transport manager in May 2007.

The Tribunal said the two matters that had ranked highest with the DTC were the sale of the company for £1 and Dobbs continuing role as transport manager. The DTC seemed to have overlooked Dobb's assertion that he had written to the TAO. A copy of the letter was handed to the Tribunal.
