• A firm acting on behalf of a former ANC franchise which collapsed following an expansion has been awarded almost £200,000.

Winchester firm Clark Coldring and Page (COP) sued ANC on behalf of Ian Stewart, trading as Rapid Freight, who operated a Devon-based franchise.

COP was originally claiming at least 11.2m compensation for Stewart's failed company, insisting that a business plan prepared by ANC and Stewart guaranteed the firm £84,000 a year, but this was dismissed on the second day of the trial.

With one claim still awaiting the judge's ruling, Judith Clark of Clark Goldring and Page says she is relatively pleased by the case so far, although the settlement, much of which was agreed out of court, is much smaller than the sum originally claimed.

Stewart adds: "Given that we are a small concern and ANC is a big firm, we are not doing too badly."

He claims that Rapid Services went into almost immediate decline as soon as it expanded in May 1995, blaming faulty business advice—a claim that ANC strongly refutes. ANC says that Stewart did not put any sales effort into the expansion despite this being an essential part of the business plan.

Although Stewart is claiming a moral victory, he admits the money could be wiped out by legal bills.
