THE OWNER OF Yorkshire haulage company Keith Brown Transport has received a 240-hour community punishment order with £55 costs for falsifying Lich() records following an accident in which driver Paul Takvam died.

Keith Brown, from Cast leford, pleaded guilty to 11 charges of breaching drivers' working hours (CM 8 September). It was revealed that Brown had been prosecuted for similar offences after Takvam's vehicle was involved in another serious accident two years ago.

The offences came to light after Suffolk police investigated the Takvam's death. He had been driving back to Yorkshire along the Al4 from Felixstowe in December 2004 when he crossed the central reservation and crashed through a bridge parapet,plunging 12m onto a minor road.

Takvam was pronounced dead at the scene but his 13-year-old son Ethan, who was in the cab at the time, was flung clear and escaped with minor injuries.

The coroner recorded a verdict of accidental death after hearing evidence suggesting Takvam had fallen asleep at the wheel. A police investigation revealed Takvam had routinely falsified his drivers' records and had driven excess hours.

Prosecutor Paul Forshaw told the court: "This is a dramatic illustration of what happens when drivers are exhausted."

The court heard that since Takvam's death Brown had disposed of the business.

A VOSA spokesperson says: "Keith Brown no longer holds a licence for six vehicles and six trailers and he has surrendered his 0-licence to the North-Eastern Traffic Commissioner."
