AN OPERATOR WHO was absent from his business throughout the summer has had his 10-month-old licence for four vehicles revoked and been declared unfit to hold an 0-licence. During that time four prohibitions had been issued, and these and links to a revoked operator were taken into account. A public inquiry into Anthony O'Neill's Manchester-based operation had earlier been adjourned at his request.

For O'Neill, David Glover sought a further adjournment on the grounds that O'Neill was in Spain and had been unable to return because of the illness of his son. Refusing the adjournment, Deputy Traffic Commissioner Mark Hinchcliffe said that despite requests there was no medical report of O'Neill's son's illness or documentary proof that he had intended to return to this country at the beginning of the week. He had concerns about who was running the operation in O'Neill's absence. He had been away since early June. Vehicle examiner Paul Snelson said the vehicles and operating centre had previously been used by James Brandrett, whose licence was revoked on maintenance grounds in December 2004.

Snelson made an appointment with O'Neill to carry out a maintenance investigation in February. He was met by Brandrett, who claimed he was the yard man and that the inspection records were with the maintenance provider, Lorian Transport. There was no forward planner and no maintenance contract.

Only two inspection records were available at Lorian's base and the stated inspection period of 10 weeks had been extended to 12 for one vehicle and 24 for another. Four delayed prohibitions had been issued to the vehicles in the 10-month life of the licence.

Revoking the 0-licence, the DTC directed that a further public inquiry be arranged at which he would consider disqualifying O'Neill from holding a licence.
