Which of the following most accurately describes the problem?

• A revised code of practice was launched this week changing the way employers need to handle grievance and disciplinary procedures for their workers.

The new code coincides with a change to the Employment Relations Act which gives employees a statutory right to be accompanied by a colleague or trade union official when facing disciplinary action.

Since its launch in 1977, the code has become a bible for many bosses because Employment Tribunals use it to decide whether workers have been unfairly treated at work.

Experts say the importance of sticking to it cannot be overstated and are urging employers to amend their procedures where necessary and to ensure that managers are fully acquainted with the new right of accompaniment.

Additions to the existing code include dealing with proceedings "without undue delay" and ensuring that all records of proceedings are kept confidential. When dealing with cases of illness which result in absence and poor performance, employers are advised to take into account the availability of suitable alternative work.
