Moody, of Bute Avenue,

Hathershavv, Oldham, pleaded guilty to one offence of falsifying a tachograph record and to one offence of taking insufficient daily rest, when he appeared before Oldham magistrates.

Prosecuting for the Department of Transport, John Heaton said Moody's Scania artic was seen in a silent check on the M4 Motorway in Gwent, close to Junction 32, at 09:57hrs on 30 November. A subsequent examination of Moody's tachograph chart for that day revealed a clear discrepancy between the silent check and the details recorded on the chart, which purported to show that Moody had started dri

ving at Newport at 13:00hrs.

When interviewed, Moody had said that he had parked up the night before outside the factory where he was to pick up his load. He was knocked up at about six in the morning by the security guard because he was causing an obstruction to workers entering the factory He was told he could load there and then, which he did. It was rush hour, the roads were congested and he decided to pull the fuse and drive to the next service station which was about five miles away. He got to the service station at about 10:C0hrs and had breakfast. He then continued his break until setting off at Mis-match: disc 13:00hrs. and silent check.
