Which of the following most accurately describes the problem?

• A company's licence application was refused when the previ ous North Western Traffic Commissioner Martin Albu advised it that it need not be legally represented. Now it is waiting to see if its second bid has been successful.

Current North Western Traffic Commissioner Keith Waterworth has reserved his decision on an application by flanks Developments, of Birkenhead, for a new one-vehicle restricted I icence.

Albu initially refused the application, following opposition from Wallasey Borough Council and neighbouring residents on environmental grounds. The company appealed against Albu's decision and the Transport Tribunal directed that the case should be reheard by a different Commissioner.

The council and the residents complained about the vehicle reversing into the street when leaving.

For the company, Jonathan Lawton said that all local residents had to reverse their vehicles into the street. The company was aware that care was required and there was no history of accidents. He said that the company operated a 6.5-tonne pickup which left each morning at 08:00hrs, travelling some 40m along the street, and returned at about 16:30hrs. That was the extent of the environmental impact, Lawton maintained. He added that when not in use the vehicle was kept in the company's warehouse.

The TC will announce his decision in writing.
