DESPITE strong opposition from British Railways—the sole objector— an application by Distributor Deliveries Ltd., of Plymouth, to switch 22 vehicles from Contract A to open A licence was granted by the East Midland Licensing Authority, Mr. C. M. Sheridan, on Tuesday. The grant was subject to an agreed amendment to the normal user sought.

For the applicants, Mr. Ian Jenkins said that the application had been brought under Section 180 of the 1960 Road Traffic Act in respect of B. J. Henry Ltd., and Hopper Organ (Car Transporters) Ltd., both companies being controlled by the applicants. A third company, Auto Car Transporters Ltd., of Birmingham, also under the control of Distributor Deliveries, had successfully applied for a Contract A to A switch in the West Midland traffic area last November, Mr. Jenkins said.

Giving evidence, Mr. S. T. Alton, a director of the three companies in the group, said that there had been many difficulties in meeting commitments and the application, if granted, would permit greater flexibility and efficiency. The earnings of the Contract A vehicles were only about half of those of the A-licensed vehicles, which averaged about £8,500 per annum each.

Cross-examining for British Railways, Mr. F. Crichton suggested that a letter from Nuffield' Exports Ltd., which was produced in evidence, did not say that they wanted to surrender the Contract A licences. Although they had sent witnesses in the past, they had not done so on this occasion, he added. Mr. Crichton asked the witness how many of the 350 to 400 trade plates would be given up if the licence were granted. Mr. Alton replied that driver deliveries had doubled in the past two years and it was possible that the number of trade plates would increase because, he said, of the "astronomical increase in car production ".

The application was granted subject to the user being restricted to the carriage of BMC manufactured vehicles only.
