I N a case heard at St. Albans County

Court last Week before Judge Granville Smith, The Commercial Motor was acknowledged to have been instrumental in securing the' successof a claim for loss of use of a vehicle. The case was that of Batchelor v. Waters, in which the plaintiff was the proprietor of a " drive yourself" car hire service. One of his cars, while hired to -a customer, was involved in a collision with the defendant's car and was damaged. On behalf of the defendant,. it was claimed that income tax must be taken into account in computing the sum to be awarded to the plaintiff. Mr. R. L. Archdale, for the plaintiff, disputed this and quoted the decision in Herring v. British Transport Commission. His attention had been drawn to this case by a reference in The Commercial Motor on February 21. Failing to find the case reported in any of the recognized law reports, he obtained a transcript of the relevant portion of Mr. Justice Donovan's judgment from this journal the day before the bearing. The transcript was accepted as evidence by the judge, who felt bound to follow Mr. Justice Donovan's ruling. He, therefore, made no tax deduction from the sum of £44 awarded to the plaintiff.

MOST TYRE PRICES DOWN BY 5 PER CENT.

MANY popular makes of tyre are cheaper by 5 per cent, this week. The Dunlop Rubber Co., Ltd., lowered their prices on Saturday, in company with the Avon India Rubber Co., Ltd., North British Rubber Co., Ltd., and the Michelin Tyre Co., Ltd. Two days later, the Firestone Tyre and Rubber Co., Ltd., and Pirelli, Ltd., announced similar reductions. The Goodyear Tyre and Rubber Co. (Gt. Britain), Ltd., were expected to follow suit within a few days. In general, the cuts apply to tyres, tubes, flaps and remoulds. A Pirelli spokesman said many of their customers would save about £2,500 a year on tyre bills, and other companies, spoke of reductions of more than £30 in retyring vehicles.

TYRE TENDERS TO REGISTRAR?

HAVING received identical tenders 'from seven tyre companies for the provision and delivery of Motorbus and trolleybus tyres in the three years commencing April 1, 1958, Brighton Transport Committee wish the town clerk to forward details to the Association of Municipal Corporations, so that the Registrar of Restrictive Trading Agreements may be informed. Each company had offered a mileage rate of 0.795d.„with a 71-per-cent, rebate and a 14-per-cent. allowance for fitting tyres by the undertaking's own staff. The contract has been awarded to the Firestone Tyre and Rubber Co., Ltd., on the recommendation of the general manager.
