Which of the following most accurately describes the problem?

• West Midland LA John Mervyn Pugh adjourned consideration of a licence renewal bid by Hereford-based Mark and Nigel Howarth, trading as Golden Valley Agricultural Services, after he heard they were selling the business.

The firm appeared at a Birmingham public inquiry to renew their licence for nine vehicles and nine trailers. It had been prematurely terminated because of maintenance problems. Mark Howarth told the LA managers had put everything into operation that had been suggested; Mervyn Pugh said that it was to their credit that they had now been able to maintain and keep their vehicles properly and safely.

Howarth wanted to withdraw the renewal application as the firm had sold the transport side of the operation to Bellblock Trading, which would trade as Golden Valley Transport Services, though they wished to be able to continue until that company's new licence came into effect.

Adjourning the hearing, Mervyn Pugh said he would not grant renewal, though he would have done ordinarily. This would enable the partners to go on operating under continuing rights: the alternative was to grant a licence which would be surrendered almost immediately.
