A DECISION by the North Western Licensing Authority to suspend A rdphalt Asphalt (Transport) Ltd's threevehicle operator's licence for three months has been upheld by the Transport Tribunal.

The North Western LA began proceedings against the company of Middleton, Lancashire last March when he told the company he was going to take consideration of two delayed prohibitions anti one immediate prohibition as well as the unsatisfactory nature of the facilities for inspection and maintenance of vehicles, and also an unsatisfactory records system.

At a public inquiry a vehicle examiner reported numerous vehicle defects and said that no proper system of records was being kept. One reason for this state bf affairs was an unsatisfactory mechanic whom the company had dismissed. At the time of the inquiry a garage was being employed to look after maintenance.

The LA reserved his decision and a further vehicle examination was carried out in July. One vehicle had been issued with a defect notice listing five defects, the second vehicle had a delayed prohibition imposed because of five defects and the third vehicle was issued with an immediate prohibition in respect of 18 defects, four of which were considered dangerous. It was on this information that the LA made his decision.

Before the Tribunal, the operator blamed the state of the vehicles on unsatis factory work by the garage concerned. He had been dealing with another concern since September. In its written decision, the Tribunal says it hopes the new arrangements will prove satisfactory.
