A BUTCHER WITH a history of misdemeanours and undeclared offences has been granted a restricted licence on condition that he employ a qualified transport manager to oversee his operation.

There is no legal requirement for a restricted licence holder to have a transport manager. but North-Eastern Traffic Commissioner Tom Macartney imposed the condition before authorising the use of four vehicles by Shazad lqbal. trading as IQ Halal Butchers A previous licence held by lqbal had been terminated in December 2005 because the renewal fee was not paid on time.

In July 2002 Iqbal had been prosecuted at Wetherby, West Yorks for offences including having no 0-licence. The TC said there was an extensive list of undeclared convictions and further prosecutions were pending.

Traffic examiner Nigel Pollard said that in March a vehicle belonging to lqbal had been stopped in Huddersfield,West Yorks. Ti was displaying an expired disc: the two-yearly tachograph inspection was overdue; and the driver did not have the correct licence. In July the same vehicle driven by the same driver was stopped in Dewsbury, West Yorks.This time no 0-licence disc was displayed. When interviewed, Iqbal said the firm had been busy and needed to use the vehicle.

lqbal said he had not tried to mislead or conceal but was unsure which convictions must be notified. He thought the licence had been renewed because money had been taken from the firm's account.

On the second occasion that the vehicle was stopped the driver was driving without authority because the nominated driver was ill. However, lqbal admitted that the vehicle had been repeatedly used without licence authority. He added that the vehicles were currently being used by another firm, Medina Poultry & Meat.which was paying the drivers.

The TC said that was an improper arrangement as Medina held only a restricted licence and could not carry goods for hire or reward. He adjourned the hearing for three days to allow lqbal to locate a qualified transport manager.

When the hearing resumed, CPC holder John Steele said he had entered a contract with lqbal and would visit his site regularly. initially every day.

CHANCE TO GET IT RIGHT The TC took the unusual step of ordering a restricted licence holder to employ a transport manager because he believed the operator desperately needed someone to help him get it right.
