Which of the following most accurately describes the problem?

Oldbury-based driver Philip Brooks has appeared before West Midland Traffic Commissioner David Dixon following his conviction for a 6% second-axle overload.

Brooks was convicted in November while working for TSA Haulage of Halesowen.

He told a Birmingham public inquiry that he had been driving a six-wheeled tipper carrying sand from Lydiate Ash to Warwick. The vehicle had been loaded by mechanical shovel and he had check-weighed the gross weight at the plate weighbridge at the Quarry, finding that it came Out at 24,900kg, which was long Inside the legal limit.

He had carried similar loads in the past without any problems and the load looked right. it was not possible to check-weigh axles at Lyd late Ash, and when he was stopped in a weight check at the Quinton dynamic axle weigher the second axle was found to be overloaded.

In reply to the TO, Brooks said that following that incident he had been checking the front axle weight, and if that was well inside its limit he adjusted the load forwards so he knew the rear axles would be okay.

Taking no action against Brooks' HGV entitlement. the TO said that he had clearly learned from the incident.
