Which of the following most accurately describes the problem?

A GLASGOW operator who told traffic examiners he was too busy to produce tachograph records has had his seven-vehicle licence suspended for 10 days.

Glasgow-based Saeed Mohammed, trading as 786 Apollo Foods, was appearing before Scottish Traffic Commissioner Joan Aitken. She was told Mohammed had failed to comply with a request to produce tachograph records for the period 1 April 10 12 May 2007.

Mohammed had said he would prefer it if the charts were personally collected as he did not wish to risk their loss in the post. Accordingly, traffic examiners called on 30 May but were told to go away because he was too busy. On 4 June he telephoned Vosa to say he could not produce the records as a member of staff was on holiday.

On 7 June when he was again visited by examiners he refused to be cautioned and was warned he was committing an offence. Mohammed offered his company digital tachograph card so the examiners could download the information, but was told that downloading driver information was his responsibility. On 19 June Vosa received a letter from him to say he had purchased equipment to download the information.

Mohammed admitted he had still not complied with the request to produce tachograph records and had 'messed the traffic examiners about'. He said he would meet his drivers the following day and show them what they were doing wrong and how to operate their breaks. He would put everything in 100% order.

The TC said Mohammed had masked or deflected attention or deliberately acted to prevent the detection of drivers' hours offences. Thus the black cloud of suspicion hung over him and she could not take a benign view of such behaviour.
